Official Rules
NO PURCHASE OR
PAYMENT NECESSARY TO ENTER OR WIN A PRIZE. MAIL-IN AND
AUTOMATIC ENTRIES HAVE AN EQUAL CHANCE OF WINNING.
1.
CAN I PARTICIPATE?
The Iowa Corn Growers
Association iCareCard
Sweepstakes
(the “Sweepstakes”) is open only to lawful residents of
the 50 United States and District of Columbia who are
members in good standing of the Iowa Corn Growers
Association, 18 years of age and older as of March 1,
2009. Void where prohibited. Employees, directors and
officers, and their immediate families (spouse, parents,
children, siblings, and their respective spouses,
regardless of where they reside), and their respective
household members, whether or not related, of the Iowa
Corn Growers Association and iCareCard, their successors
and assigns, respective parent companies, affiliates,
subsidiaries, divisions, advertising and promotion
agencies are not eligible to enter or win. Sweepstakes
is subject to all applicable federal, state, and local
laws.
2.
HOW DO I ENTER?
The Sweepstakes begins on March 11th, 2009 and ends on
June 10, 2009 (the “Sweepstakes Period”).
There are two (2) ways to enter during the Sweepstakes
Period: 1) Automatic Entry; and 2) U. S. Mail.
To enter via Automatic Entry:
If you haven’t yet done so, activate your Iowa Corn
Growers’ iCareCard at
www.icarecard.org
(activation must be completed online).
An eligible Iowa Corn Growers Association member then
automatically receives one (1) Sweepstakes entry for
each purchase made with his/her iCareCard during the
Sweepstakes Period at any merchant location in the
United States. Only purchases made with an iCareCard
card that is in good standing and processed through the
Elan Financial Services transaction-processing system
during the Sweepstakes Period, are eligible for
automatic entry. Cash advances, balance transfers, and
ATM Withdrawals or Inquiries are excluded from entry.
Cards which are stolen, fraudulent, tampered with, or
otherwise altered are not eligible for automatic entry.
Purchases of goods and/or payments for other services
not described above and/or made to a merchant not
accepting the iCareCard do not qualify for entry. Any
dispute as to whether a transaction qualifies as
eligible for automatic entry will be decided by Sponsor,
in its sole discretion. In the event of a dispute as to
who submitted a particular cardholder entry, such entry
will be deemed to be submitted by the primary person in
whose name the card used to enter the Sweepstakes was
issued.
To enter by mail without purchase or obligation:
You may enter the Sweepstakes without purchase via U. S.
Mail by hand-printing your name, address, city, state,
ZIP code, date of birth, e-mail address (if any) Iowa
Corn Growers Association Member Number, and daytime and
evening telephone numbers (including area code) on a 3”
X 5” card, and mailing, in a #10 envelope with postage
affixed, to: iCareCard Sweepstakes PO Box 11100 Cedar
Rapids, IA 52410-1100. Mail-in entries must be
postmarked by June 10, 2009 and received no later than
June 13, 2009 in order to be eligible to win. Enter as
often as you wish; however, each mail-in entry must be
mailed in a separate, postmarked stamped envelope.
Entries that are mechanically reproduced, copied,
illegible, incomplete or inaccurate are void. All
entries become the property of the Sponsor and will not
be acknowledged or returned. Responsibility for receipt
of entry rests solely with the entrant

HOW DO I WIN? There is a two-step
process to determine the winners. First, ten
(10) potential winners will be selected in a random
drawing on or about June 13, 2009 from all eligible
automatic and mail-in entries received. A random drawing
will be conducted by MGM Creative, an independent
judging organization whose decisions are final and
binding on all matters relating to this Sweepstakes.
Potential winner will be notified by overnight mail,
telephone or e-mail on or about June 14, 2009. Potential
winner will be required to sign an affidavit of
eligibility/liability release and where legal, a
publicity release, and return these documents, properly
executed, via U.S. mail, within 5 days of date of
issuance of notification. Non-compliance within this
time frame, with these Official Rules, or if Sponsor is
unable to contact potential winner within a reasonable
time period or prize or prize notification being
returned as undeliverable, will result in such potential
winner being disqualified and, at Sponsor’s discretion,
an alternate potential winner may be selected.
Second, four cash prize winners will be selected
from the ten potential winners by random draw at the
Iowa Corn Indy 250 at the Iowa Speedway on June 21, 2009
in Newton, Iowa. Winners do not have to be present in
order to claim their prizes.
4.
WHAT CAN I WIN? Two Grand Prizes:
Two (2) Grand Prize winners will each receive $1,000 to
be awarded in the form of a check. Two First
Prizes: Two (2) First Prize winners will each
receive $500 to be awarded in the form of a check.
All Ten Potential Winners: Ten (10) potential prize
winners will each receive two general admission tickets
to the June 21, 2009 Iowa Corn Indy 250 at the Iowa
Speedway in Newton, Iowa. Approximate Retail Value
(“ARV”) of all Prizes: $3,520. All federal, state, and
local taxes are the sole responsibility of the winners.
Prize may not be transferred or substituted, except at
the Sponsor’s sole discretion. Sponsor reserves the
right to substitute the prize with one of comparable or
greater value, at its sole discretion. If winner is
deemed a minor in his/her state or place of residence,
prize may be awarded in the name of his/her parent or
legal guardian who will be responsible for fulfilling
all requirements imposed on winner set forth herein.
5. WHAT’S MY CHANCE TO
WIN? Odds of winning depend upon the number of
entries received.
6.
CONDITIONS OF PARTICIPATION:
By entering, entrants agree to be bound by these
Official Rules including all eligibility requirements.
By accepting a prize, the winner consents to the use of
his/her name, image, likeness, photograph, voice, and
biographical material for advertising, publicity and
promotional purposes by Sponsor, or a party designated
by the Sponsor, in any and all media now or hereafter
devised, including but not limited to, any online
announcements, worldwide in perpetuity, without
additional compensation, notification or permission,
except where prohibited by law. Entrants release and
hold harmless the Iowa Corn Growers Association and
iCareCard, their successors and assigns, parent
companies, affiliates, subsidiaries, divisions,
advertising and promotion agencies and all of their
respective employees, officers, directors and
shareholders (collectively, “Released Parties”), from
any claims, actions, injury, loss or damage of any kind,
including but not limited to, personal injury or death,
resulting from participating in this Sweepstakes or from
the acceptance, possession, or use or misuse of the
prize awarded. This limitation of liability is a
comprehensive limitation of liability that applies to
all damages of any kind, including (without limitation)
compensatory, direct, indirect, or consequential
damages; loss of income or profit; loss of damage to
property; and claims of third parties.
7.
DATA PRIVACY:
Information participants provide to Sponsor will be used
to communicate with participants in relation to the
Sweepstakes. Winners’ names, ages, cities and states of
residence may be posted on the Sponsor’s website.
8.
GENERAL:
Released Parties
are not responsible for lost, late, illegible,
misdirected, inaccurate, incomplete, delayed, postage
due or stolen mail, entries or transactions, or for
transactions that are lost, misdirected, or fail to
enter into the processing system; or are processed,
reported or transmitted late or incorrectly; or for any
other errors or problems of any kind, whether
typographical, printing, mechanical, human, electronic
or otherwise, relating to or in connection with the
Sweepstakes, including, without limitation, any error or
problem which may occur in connection with the
administration of the Sweepstakes, the processing of
entries, the announcement of the prize or in any
Sweepstakes-related materials. Sponsor reserves the
right, in its sole discretion, to cancel or suspend part
or all of this Sweepstakes at any time without notice,
if in the judges’ opinion there is any suspected or
actual evidence of non-authorized human intervention or
other causes corrupt or impair the administration,
security, fairness or integrity and proper play of the
Sweepstakes. In such event, Sponsor may void any entries
it suspects are at issue and, at its discretion, if
terminated, award prize in a random drawing from among
all non-suspect, eligible entries received up to the
date of cancellation. Sponsor’s failure to enforce any
term of these Official Rules shall not constitute a
waiver of that or any other provision. Sponsor reserves
the right to disqualify entrants who violate the rules
or interfere with this Sweepstakes in any manner and
void all associated entries.
9.
DISPUTES: By entering, each
entrant agrees that: (1) any and all disputes, claims,
and causes of action arising out of or in connection
with this Sweepstakes, or any prize awarded, shall be
resolved individually, without resort to any form of
class action, and any judicial proceeding shall take
place in a federal or state court within the State of
Iowa; (2) any and all claims, judgments, and awards
shall be limited to actual out-of-pocket costs incurred,
including costs associated with entering this
Sweepstakes, but in no event attorneys’ fees; and (3)
under no circumstances will a entrant be permitted to
obtain awards for, and each entrant hereby waives all
rights to claim punitive, incidental, or consequential
damages, any other damages other than actual
out-of-pocket expenses, and any and all rights to have
damages multiplied or otherwise increased. All issues
and questions concerning the construction, validity,
interpretation and enforceability of these Official
Rules, or the rights and obligations of entrants and the
Sponsors in connection with the Sweepstakes, shall be
governed by and construed in accordance with the laws of
the State of Iowa, without giving effect to any choice
of law or conflict of law rules or provisions (whether
of the State of Iowa or any other jurisdiction) that
would cause the application of the laws of any
jurisdiction other than the State of Iowa.
10.
WINNERS’ NAMES:
To obtain the name
of the Grand and First Prize winners, available after
July 1, 2009, mail a self-addressed stamped envelope no
later than October 1, 2009 to: iCareCard Winner’s List,
PO Box 11100 Cedar Rapids IA 52410-1100.
11.
SPONSOR:
The Sponsor of this Sweepstakes is iCareCard PO Box
11100 Cedar Rapids IA, 52410-1100. Sponsor reserves the
right to cancel the Sweepstakes at any time and
substitute another promotion in its place.
